Platform Terms of Use

1. Introduction

1.1 The Veteran Mindfulness Australia Platform is operated by Veteran Mindfulness Australia Pty Ltd 641 718  (‘we’, ‘us’ and ‘our’).

1.2

By becoming an Active User of the Veteran Mindfulness Australia Platform you agree to abide by these Platform Terms & Conditions and any amendments as posted to our website.

1.3 For the purposes of these terms and conditions, the following definitions apply:

Active User” means a veteran of the Australian Defence Force (ADF) who holds a valid Gold Card or White Card with an accepted mental health condition or Non-Liability Health Care (NLHC) activated who has current access to the Veteran Mindfulness Australia Platform, including a mindfulness coach, in accordance with the Platform Terms & Conditions.

Platform Terms of Use” means these terms of use and any other document incorporated by reference in these terms of use. A reference in the Terms of Use to the singular includes the plural and vice versa.

“Veteran Mindfulness Australia Platform” means the platform operated by Veteran Mindfulness Australia providing access to various mindfulness tools, resources and services.

1.4 We reserve the right to change the Platform Terms & Conditions at any time without notice subject to relevant state/territory legislation approval by posting such changes on our website www.veteranmindfulness.com.au.

The laws of the relevant state/territories apply to these Promotional Item Terms & Conditions and the General Promotional Item Terms & Conditions.

2. Use of the Platform

2.1

Use of the Veteran Mindfulness Australia Platform is open to persons who meet the following criteria (“Eligible Person”):

(a) a veteran of the Australian Defence Force (ADF) who holds a valid Gold Card or White Card with an accepted mental health condition or Non-Liability Health Care (NLHC) activated;

(b) a resident of Australia;

(c) persons who are at least 18 years old.

2.2

We reserve the right to remove access to the Veteran Mindfulness Platform from any user for the following reasons:

(a) We become aware that a user was not or is no longer an Eligible Person;

(b) A user has not engaged with their mindfulness coach for a period of 14 or more days;

(c) A user engages in conduct in relation to the Veteran Mindfulness Australia Platform in a manner which Veteran Mindfulness Australia considers in its sole discretion to be inappropriate.

3. Anti-Money Laundering (AML) Policy

3.1 In the event that a refund of monies paid for the relevant product(s) or service(s) purchases as part of the relevant Veteran Mindfulness Australia Platform is approved by us, the refunds will only be issued via the same method in which payment was originally received and will be processed in Australia dollars.

3.2 Combined with the contact details provided by the user of the Veteran Mindfulness Australia Platform the above refund policy is designed to prevent money laundering activities.

4. Hyperlinks, Advertising, Sponsors & Third Party Content

4.1 Our website or application may contain the content of third parties (Third Party Content).  This content may include but is not limited to hyperlinks to external (third party) websites or program sponsors.  None of these things is to be taken as an endorsement, recommendation or approval of the third party, or sponsor or their products or services. We accept no responsibility for the accuracy, currency or suitability or otherwise regarding Third Party Content. Any use or reliance on such content is at your own risk and we do not accept liability for any loss, damage, costs or expenses arising as a result of the use or reliance.

4.2 Where hyperlinks to third party websites are provided, we make no claims regarding the suitability or otherwise of the third party’s products or services to your needs, nor does it warrant the third party website is free of viruses, trojans or other malicious software.

5. Privacy and Communications

5.1 You agree that your use of the Veteran Mindfulness Australia Platform constitutes an invitation for us to contact you in relation to, among other things, offering you services or resources.

5.2 To use the Veteran Mindfulness Australia Platform you must supply at least one method of contact and we reserve the right to send you service-related communications to you subject to our Privacy Policy regardless of your contact preference. These service-related communications may include, by way of example only, updates to the Terms and Conditions, to deliver resources or services, updates to our privacy policy and anything else incidental to the use of the Veteran Mindfulness Australia Platform.

5.3 Our Privacy Policy is available on our website www.veteranmindfulness.com.au for information on how we deal with your personal information and how you may elect to opt out of marketing communications.

6. Disclaimer

6.1 Any and all products, brand names, logos, images and/or trademarks as displayed or referred to on our website or the Veteran Mindfulness Australia Platform are owned by the respective trademark owners.  We do not warrant to have an affiliation with any trademark owner referenced on this website who is not us. 

6.2 We use all reasonable endeavours to ensure that information on the Veteran Mindfulness Australia Platform is correct but we do not warrant the accuracy or completeness of the information provided and will not be held liable for any inaccuracy, omission, variation or error.

6.3 To the extent permitted by law, including pursuant to schedule 2 of the Competition and Consumer Act 2010 (Cth) (‘Australian Consumer Law’), we shall not be liable for any loss or damage of whatsoever nature however occasioned to any person by, through or in connection with the Veteran Mindfulness Australia Platform (including but not limited to direct, indirect or consequential loss or damage or personal injury).

7. Disputes

7.1 Any and all disputes, claims and causes of action arising out of or in connection with the Veteran Mindfulness Australia Platform must be resolved individually and not by any form of class action.

7.2 All users of the Veteran Mindfulness Australia Platform agree to participate in alternative dispute resolution, including but not limited to mediation, regarding any and all disputes, claims and causes of action before resorting to the commencement of legal proceedings.
