Platform Terms of Use 

1. Introduction

1.1 The Veteran Mindfulness Australia Platform is operated by Veteran Mindfulness Australia Pty Ltd 641 718  (‘we’, ‘us’ and ‘our’).

1.2 By becoming an Active User of the Veteran Mindfulness Australia Platform you agree to abide by these Platform Terms of Use and any amendments as posted to our website.

1.3 For the purposes of these terms and conditions, the following definitions apply:

Active User” means a veteran of the Australian Defence Force (ADF) who holds a valid Gold Card or White Card with an accepted mental health condition or Non-Liability Health Care (NLHC) activated who has current access to the Veteran Mindfulness Australia Platform, including a mindfulness coach, in accordance with the Platform Terms of Use.

Platform Terms of Use” means these terms of use and any other document incorporated by reference in these terms of use. A reference in the Terms of Use to the singular includes the plural and vice versa.

Veteran Mindfulness Australia Platform” means the platform operated by Veteran Mindfulness Australia providing access to various mindfulness tools, resources and services.

1.4 We reserve the right to change the Platform Terms of Use at any time without notice subject to relevant state/territory legislation approval by posting such changes on our website www.veteranmindfulness.com.au.

1.5 The laws of the relevant state/territories apply to these Platform Terms of Use and any Prize Draw Terms & Conditions and Wellness Support Item Terms & Conditions.

2. Use of the Platform

2.1 Use of the Veteran Mindfulness Australia Platform is open to persons who meet the following criteria (“Eligible Person”):

(a) a veteran of the Australian Defence Force (ADF) who holds a valid Gold Card or White Card with an accepted mental health condition or Non-Liability Health Care (NLHC) activated;

(b) a resident of Australia;

(c) persons who are at least 18 years old.

2.2 We reserve the right to remove access to the Veteran Mindfulness Platform from any user for the following reasons:

(a) We become aware that a user was not or is no longer an Eligible Person;

(b) A user has not engaged with their mindfulness coach for a period of 14 or more days;

(c) A user engages in conduct in relation to the Veteran Mindfulness Australia Platform in a manner which Veteran Mindfulness Australia considers in its sole discretion to be inappropriate.

3. Anti-Money Laundering (AML) Policy

3.1 In the event that a refund of monies paid for the relevant product(s) or service(s) purchases as part of the relevant Veteran Mindfulness Australia Platform is approved by us, the refunds will only be issued via the same method in which payment was originally received and will be processed in Australia dollars.

3.2 Combined with the contact details provided by the user of the Veteran Mindfulness Australia Platform the above refund policy is designed to prevent money laundering activities.

4. Hyperlinks, Advertising, Sponsors & Third Party Content

4.1 Our website or application may contain the content of third parties (Third Party Content).  This content may include but is not limited to hyperlinks to external (third party) websites or program sponsors.  None of these things is to be taken as an endorsement, recommendation or approval of the third party, or sponsor or their products or services. We accept no responsibility for the accuracy, currency or suitability or otherwise regarding Third Party Content. Any use or reliance on such content is at your own risk and we do not accept liability for any loss, damage, costs or expenses arising as a result of the use or reliance.

4.2 Where hyperlinks to third party websites are provided, we make no claims regarding the suitability or otherwise of the third party’s products or services to your needs, nor does it warrant the third party website is free of viruses, trojans or other malicious software.

5. Privacy and Communications

5.1 You agree that your use of the Veteran Mindfulness Australia Platform constitutes an invitation for us to contact you in relation to, among other things, offering you services or resources.

5.2 To use the Veteran Mindfulness Australia Platform you must supply at least one method of contact and we reserve the right to send you service-related communications to you subject to our Privacy Policy regardless of your contact preference. These service-related communications may include, by way of example only, updates to the Terms of Use, to deliver resources or services, updates to our privacy policy and anything else incidental to the use of the Veteran Mindfulness Australia Platform.

5.3 Our Privacy Policy is available on our website www.veteranmindfulness.com.au for information on how we deal with your personal information and how you may elect to opt out of marketing communications.

6. Disclaimer

6.1 Any and all products, brand names, logos, images and/or trademarks as displayed or referred to on our website or the Veteran Mindfulness Australia Platform are owned by the respective trademark owners.  We do not warrant to have an affiliation with any trademark owner referenced on this website who is not us.

6.2 We use all reasonable endeavours to ensure that information on the Veteran Mindfulness Australia Platform is correct but we do not warrant the accuracy or completeness of the information provided and will not be held liable for any inaccuracy, omission, variation or error.

6.3 To the extent permitted by law, including pursuant to schedule 2 of the Competition and Consumer Act 2010 (Cth) (‘Australian Consumer Law’), we shall not be liable for any loss or damage of whatsoever nature however occasioned to any person by, through or in connection with the Veteran Mindfulness Australia Platform (including but not limited to direct, indirect or consequential loss or damage or personal injury).

7. Disputes

7.1 Any and all disputes, claims and causes of action arising out of or in connection with the Veteran Mindfulness Australia Platform must be resolved individually and not by any form of class action.

7.2 All users of the Veteran Mindfulness Australia Platform agree to participate in alternative dispute resolution, including but not limited to mediation, regarding any and all disputes, claims and causes of action before resorting to the commencement of legal proceedings.

General Prize Draw Terms & Conditions

1. Introduction

1.1 Veteran Mindfulness Australia Prize Draws are trade promotions conducted by Veteran Mindfulness Australia Pty Ltd 641 718 247 (‘we’, ‘us’ and ‘our’). The Prize Draws are conducted to promote the Veteran Mindfulness Australia Platform.

1.2 For the purposes of these terms and conditions, the following definitions apply:

Active User” means a veteran of the Australian Defence Force (ADF) who holds a valid Gold Card or White Card with an accepted mental health condition or Non-Liability Health Care (NLHC) activated who has current access to the Veteran Mindfulness Australia Platform, including a mindfulness coach, in accordance with the Platform Terms of Use.

General Prize Draw Terms & Conditions” means this document.

Terms and Conditions” means these General Prize Draw Terms & Conditions and any other document incorporated by reference in these terms and conditions. A reference in the Terms and Conditions to the singular includes the plural and vice versa.

Prize Draw” means each and every individual prize draw conducted by us to promote the Veteran Mindfulness Australia Platform.

Veteran Mindfulness Australia Platform” means the platform operated by Veteran Mindfulness Australia providing access to various mindfulness tools, resources and services.

1.3 Additional terms and conditions may apply to each Prize Draw (“Prize Draw Terms and Conditions”).  The relevant Prize Draw Terms and Conditions are available along with the information about each Prize Draw.

1.4 The Prize Draw Terms and Conditions as well as any information on how to enter a Prize Draw form part of the Terms and Conditions.

1.5 The Terms and Conditions apply to all entries into and/or prizes awarded in a Prize Draw and we reserve the right to change the Prize Terms and Conditions at any time without notice, subject to relevant state/territory legislation approval, by posting such changes on our website www.veteranmindfulness.com.au.

1.6 The laws of the various state/territories in which the Prize Draws are conducted apply to the conduct of the Prize Draws and the Terms and Conditions.

1.7 By using the Veteran Mindfulness Australia Platform or this site or application or entering into any Prize Draw you agree to abide by these Terms & Conditions and any amendments to the Terms & Conditions as posted to our website.

1.8 If any of these Terms & Conditions are found to be invalid or unenforceable, that invalidity or un-enforceability will not affect the remainder of the Terms & Conditions, which will continue in full force and effect.

2. Conditions of entry

2.1 To enter a Prize Draw, a person must join and be an Active User of the Veteran Mindfulness Australia Platform and correctly complete the details required at the time of joining (“Entry Details”’).

2.2 The person whose details are provided with the Entry Details will be the person to whom prizes will be transferred and that is deemed to have agreed to and accepted these Terms and Conditions so far as they apply to entry into the relevant Prize Draw.

2.3 Entry in the Prize Draws is open to persons who are Active Users of the Veteran Mindfulness Australia Platform who have become Active Users of the Veteran Mindfulness Australia Platform as part of the relevant promotion of the Veteran Mindfulness Australia Platform and meet the following criteria (“Eligible Person”):

(a) a veteran of the Australian Defence Force (ADF) who holds a valid Gold Card or White Card with an accepted mental health condition or with Non-Liability Health Care (NLHC) activated.

(b) a resident of Australia who is not excluded in the relevant Prize Draw Terms and Conditions.

(c) persons who are at least 18 years old.

(d) persons who are who are not Ineligible Persons 

2.4 The following persons are ineligible for entry in the Prize Draws (“Ineligible Persons”):

(a) a member of our management committee, including our board of directors and executive management;

(b) our employees or employees of our subsidiaries or associate entities;

(c) all other parties (and their employees and agents) directly engaged in conducting the Prize Draw;

(d) a family member of a person caught by paragraphs (a) and (b), including spouses, de facto spouses, parents, step-parents, siblings, step-siblings, children and adopted children.

2.5 It is your responsibility as an entrant in a Prize Draw to ensure that you are eligible under all applicable laws to accept the prize should you win the Prize Draw.

2.6 We reserve the right to disqualify entries in the event of non-compliance with the Terms and Conditions.

2.7 All prize values are listed in Australian currency.

2.8 By entering into a Prize Draw an entrant agrees to provide photographs or other media with any prizes won in a Prize Draw as reasonably requested of them and also to permit us to film content of the entrant with the prize for reasonable promotional purposes.

2.9 By entering into a Prize Draw an entrant agrees not to make any defamatory or derogatory comments on any social media platforms or other public forum against us, the Veteran Mindfulness Australia Platform, the Prize Draw, any prizes or anything incidental to the Veteran Mindfulness Australia Platform or Prize Draws.

3. Anti-Money Laundering (AML) Policy

3.1 In the event that a refund of monies paid for the relevant product(s) or service(s) purchases as part of the relevant Veteran Mindfulness Australia Platform is approved by us, the refunds will only be issued via the same method in which payment was originally received and will be processed in Australia dollars.

4. Transfer of prizes

4.1 Where we are unable to provide you with the nominated prize, or you are unable to legally own or receive the nominated prize, or where we are unable deliver a prize due to natural disaster, fire, theft, destruction or other circumstances beyond our control as may arise from time to time, we may at our discretion offer you a substitute prize of the same value in Australian Dollars in our absolute discretion, subject to any written consent required from any relevant state or territory government department.

4.2 Where we are unable to provide you with the nominated prize, or you are unable to legally own or receive the nominated prize, or where we are unable deliver a prize due to natural disaster, fire, theft, destruction or other circumstances beyond our control as may arise from time to time, we may at our discretion offer you a substitute prize of the same value in Australian Dollars in our absolute discretion, subject to any written consent required from any relevant state or territory government department.

4.3 If you are a foreign resident and you are declared to be the winner you may be required to obtain relevant approvals from a relevant government authority in Australia before we can transfer the prize to you. If such approval is required, you must promptly apply to the relevant authority and obtain requisite approval within a reasonable time before the prize can be transferred to you. We may assist in this process but are not obligated to do so. You are responsible for the costs of any application and also for any costs associated with the acquisition of land by a foreign person, other than those costs set out in these Terms and Conditions.

4.4 If there is no winner of a prize or we are unable to find a prize winner, we will publish this fact on our website and social media channels.

4.5 Subject to any applicable Prize Draw Terms and Conditions, if a prize is unclaimed, the winner cannot be contacted, or the prize is otherwise not awarded within three (3) months of the original draw date, we reserve the right to conduct a redraw and award the prize to the next eligible entrant, in accordance with all applicable state and territory laws and any directions of relevant regulatory authorities. Details of any redraw (including the date, time and outcome) will be published on our website and, where required by law, notified to the relevant state or territory regulatory authority.

Wellness Support Item Terms & Conditions

1. Introduction

1.1. Veteran Mindfulness Australia Wellness Support Items are provided by Veteran Mindfulness Australia Pty Ltd 641 718 247 (‘we’, ‘us’ and ‘our’).

1.2 The Wellness Support Item is offered to support an Active User’s engagement with and/or use of resources or services available through the Veteran Mindfulness Australia Platform.

1.3 These Wellness Support Item Terms & Conditions apply all Wellness Support Items offered by us, including items offered as part of specific campaigns or offers.

1.4 Our Platform Terms of Use also apply to these Wellness Support Item Terms & Conditions. Any definitions used in the Platform Terms of Use apply unless otherwise stated.

1.5 For the purposes of these Wellness Support Item Terms & Conditions, the following definitions apply:

Active User” means a veteran of the Australian Defence Force (ADF) who:

Platform Terms of Use” means the Platform Terms of Use which are available on our website.

“Offer” means a Wellness Support Item offer made available through a specific campaign.

“Offer Period” means the period during which a Wellness Support Item is available to eligible Active Users as part of a specific Wellness Support Item campaign, commencing on the date the Offer is made available by Veteran Mindfulness Australia and ending on the earlier of:

Veteran Mindfulness Australia Platform” means the platform operated by Veteran Mindfulness Australia providing access to various mindfulness tools, resources and services.

Wellness Support Item” means one (1) physical item provided to an Active User as part of a specific Wellness Support Item Offer as determined by us from time to time. A Wellness Support Item may include, but is not limited to, the following items (or similar items of a comparable nature):

The type, specifications and approximate retail value of a Wellness Support Item will be as advertised for the relevant campaign or Offer and are subject to availability.

“Wellness Support Item Terms & Conditions” means, for this Wellness Support Item, this document.

1.6 We reserve the right to change the Wellness Support Item Terms & Conditions, and the Platform Terms of Use, at any time without notice subject to relevant state/territory legislation approval by posting such changes on our website www.veteranmindfulness.com.au.

1.7 The laws of the relevant state/territories apply to these Wellness Support Item Terms & Conditions.

1.8 By participating in a Offer or accepting a Wellness Support Item, you agree to be bound by these Wellness Support Item Terms & Conditions and the Platform Terms of Use

1.9 If any provision of these Wellness Support Item Terms & Conditions is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

2. Offer Conditions and Eligibility 

2.1 Wellness Support Items are available while stocks last and only during the applicable Offer Period.

2.2 To be eligible to receive a Wellness Support Item, a person must:

2.4 Only one (1) Wellness Support Item may be claimed per Active User per campaign, unless otherwise stated.

2.5 An Active User may claim up to one (1) of each type of Wellness Support Item every 18 months, provided eligibility requirements are met and the claim is made through the appropriate campaign.

2.6 Wellness Support Items are not transferable, not redeemable for cash, not exchangeable, and must not be resold.

3. Delivery and Substitution 

3.1 Wellness Support Items will be dispatched within 14 business days of eligibility confirmation, subject to stock availability and delays outside our reasonable control.

3.2 Delivery costs within Australia will be covered by us. We do not deliver internationally and do not provide shipping insurance.

3.3 We do not guarantee the colour, model, design, or specifications of the Wellness Support Item shown in marketing materials.

3.4 If a Wellness Support Item becomes unavailable, we may, at our discretion, substitute it with an item of equal or greater value.

4. Use, Safety and Disclaimers

4.1 Wellness Support Items are provided for general wellbeing support only and are not medical or therapeutic devices.

4.2 You acknowledge that use of the Wellness Support Item is at your own discretion and risk, and you must follow all manufacturer instructions, warnings and safety guidelines.

4.3 We are not responsible for injury, loss or damage arising from misuse, improper use, or failure to follow manufacturer instructions.

5. Misuse and Cancellation

5.1 We reserve the right to refuse, cancel, or recover from you a Wellness Support Item if we reasonably suspect:

6. Limitation of Liability

6.1 To the extent permitted by law, we will not be liable for any indirect, incidental, consequential or special loss or damage, including (without limitation) loss of opportunity, loss of enjoyment, loss of data or loss of reputation, arising from or in connection with the provision, use or inability to use a Wellness Support Item.

6.2 To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with a Wellness Support Item (including any loss, damage or claim whether arising in contract, tort (including negligence), statute or otherwise) is limited to an amount equal to the retail value of the Wellness Support Item supplied to you.

6.3 Nothing in these Wellness Support Item Terms & Conditions excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law or other applicable legislation. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

7. Personal Information

7.1 We will collect and use personal information provided by you for the purposes of:

Zero Tolerance Policy – Client Conduct

  1.  At Veteran Mindfulness Australia, we are committed to creating a safe, respectful, and inclusive environment for both our clients and practitioners.
  2. We have a zero tolerance policy for any form of aggression, abuse, discrimination, or inappropriate behaviour. This includes, but is not limited to:
    1. Rudeness or disrespectful language
    2. Sexist, racist, or discriminatory remarks
    3. Harassment of any kind
  3. Such behaviour will not be tolerated under any circumstances. If a client engages in any of the above, their session may be immediately terminated, and ongoing access to services may be reviewed or discontinued.
