VMA Program – Terms & Conditions

Introduction

  1. These Terms & Conditions apply to the Program Support Item offered as part of the Veteran Mindfulness Australia’s Designated Program (“Offer”).
  1. In these Terms & Conditions, “we“, “us” and “our” mean Veteran Mindfulness Australia Pty Ltd ACN 641 718 247. “You” and “your” mean an Active User in this Offer.
  1. The Program Support Item will be supplied by our Product Partner. By accepting and using the Program Support Item, you agree to any terms of use, terms and conditions, or other terms applicable to the Program Support Item as may be imposed by our Product Partner, including those available on their website. It is your responsibility to review and understand any such terms before using the Program Support Item. We are not responsible for the content or enforcement of any third-party terms imposed by the Product Partner or any manufacturer of the Product Partner.
  1. For the purposes of these Terms & Conditions, the following definitions apply:
    • “Active User” means a veteran of the Australian Defence Force (ADF) who:
      • holds a valid Gold Card or White Card with Non-Liability Health Care (NLHC) activated;
      • is aged 18 years or over; 
      • is currently participating in our Designated Program; and 
      • has a confirmed upcoming appointment booked with us for the Designated Program at the time the Program Support Item is requested.
    • “Designated Program” means the Veteran Mindfulness Australia Program, or such other Veteran Mindfulness Australia program as we may specify in marketing materials from time to time.
    • “Program Support Item” means one pack of 30 adhesive nose strips, with an approximate retail value of $1.17 per nose strip (or as otherwise stated on the product packaging or accompanying materials).
    • “Product Partner” means GREATEST OF ALL TAPES PTY LTD ACN 675 391 134 (“GOAT”).
    • “Offer” means the Program Support Item offer made available exclusively through a Designated Program.
    • “Offer Period” means the period during which the Program Support Item is available to Active Users as part of the Offer, commencing on the date the Offer is made available by us and ending on the earlier of:
      • the date the Offer is withdrawn or closed by us; or
      • the date on which available stock of the Program Support Item is exhausted.
  1. We reserve the right to change these Terms & Conditions at any time by posting changes on our website: www.veteranmindfulness.com.au.
  1. The laws of Queensland, Australia apply to these Terms & Conditions, and each party submits to the non-exclusive jurisdiction of the courts of Queensland.
  1. By participating in the Offer or accepting the Program Support Item, you agree to be bound by these Terms & Conditions.
  1. If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Offer Conditions and Eligibility

  1. The Program Support Item is available on request from Active Users, while stocks last and only during the applicable Offer Period.
  1. To receive a Program Support Item, you must 
    • Be an Active User;
    • successfully complete all eligibility and verification requirements; and
    • access the Program Support Item through the Offer.
  1. Program Support Items are not available retrospectively unless we decide otherwise. 
  1. The Program Support Item will be provided no more than once every 6 weeks from the date you received your previous supply.
  1. Program Support Items are not transferable, not redeemable for cash, not exchangeable, and must not be resold.

Delivery and Substitution

  1. We aim to dispatch Program Support Items within 14 business days of confirming eligibility, subject to stock availability and delays outside our reasonable control.
  1. Delivery costs within Australia will be covered by us. We do not deliver internationally and do not provide shipping insurance.
  1. We do not guarantee the quantity, design, packaging or appearance of the Program Support Item shown in marketing materials.
  1. If a Program Support Item becomes unavailable, we may, at our discretion, substitute it with a similar non-medical product of equal or greater value.

Use, Safety and Disclaimers

  1. The Program Support Item is provided for general wellbeing support only and is not medical or therapeutic devices.
  1. You acknowledge that use of the Program Support Team is at your own discretion and risk, and you must follow all product instructions, warnings and safety guidelines.
  1. We do not make any therapeutic claims about the Program Support Item and do not guarantee any particular sleep, breathing, health or wellbeing outcome.
  1. You acknowledge that the Program Support Item may not be suitable for all skin types and may cause irritation or discomfort in some individuals.
  1. You should stop using the Program Support Item if you experience irritation, discomfort or any adverse reaction.
  1. If you have sensitive skin, allergies, medical conditions, or concerns about using the Program Support Item, you should consult your GP or treating health practitioner before use.

Misuse and Cancellation

  1. We reserve the right to refuse, cancel, or recover from you a Program Support Item if we reasonably suspect:
    • fraud, dishonesty, or misrepresentation;
    • misuse or abuse of Program Support Item; or
    • breach of these Terms & Conditions.
  2. We may cancel or withdraw the Offer at any time without notice, subject to applicable Australian consumer laws.

Limitation of Liability

  1. To the extent permitted by law, we are not responsible for injury, loss or damage arising from misuse, improper use, or failure to follow product instructions, warnings or safety guidelines.
  1. To the extent permitted by law, we will not be liable for any indirect, incidental, consequential or special loss or damage including (without limitation) loss of opportunity, loss of enjoyment, loss of data or loss of reputation, arising from or in connection with the provision, use or inability to use a Program Support Item.
  1. To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Program Support Item (including any loss, damage or claim whether arising in contract, tort (including negligence), statute or otherwise) is limited to an amount equal to the retail value of the Program Support Item supplied to you.
  1. Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law or other applicable legislation. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Personal Information

  1. We will collect and use personal information provided by you for the purposes of:
    • assessing eligibility;
    • administering the Offer; and
    • delivering the Program Support Item.
  2. Personal information will be handled in accordance with our Privacy Policy.
